The Ohio Interagency Review Team Releases the Guidelines for Stream Mitigation Banking and In-Lieu Fee Programs in Ohio, Version 1.0 for Application within the State of Ohio in the U.S. Army Corps of Engineers’ Buffalo, Huntington, and Pittsburgh Districts

 

 

JOINT PUBLIC NOTICE: This joint public notice is distributed on behalf of the Ohio Interagency Review Team (IRT), which consists of the following federal and state resource agencies: U.S. Army Corps of Engineers (Corps) Buffalo, Huntington, and Pittsburgh Districts, U.S. Environmental Protection Agency, U.S. Fish and Wildlife Service, U.S. Department of Agriculture’s Natural Resource Conservation Service, Ohio Environmental Protection Agency, and Ohio Department of Natural Resources.

 

PURPOSE: The purpose of this public notice is to distribute the document titled Guidelines for Stream Mitigation Banking and In-Lieu Fee Programs in Ohio, Version 1.0 (Guidelines). This document provides those interested in stream mitigation banking and in-lieu fee stream mitigation with a statewide guide developed by the Ohio IRT. The Guidelines have been developed to increase the likelihood for ecological success and sustainability of aquatic resources developed by mitigation banks and in-lieu fee mitigation programs. In addition, applicable portions of the Guidelines may be useful in the development of permittee-responsible mitigation sites.

 

The Ohio IRT encourages sponsors to follow these Guidelines. The Guidelines do not alter or replace any current regulations or regulatory requirements. They do not alter in any way the mitigation sequence specified in the 2008 Mitigation Rule (33 CFR 332) or in the Clean Water Act Section 404(b)(1) Guidelines (40 CFR 230).  The Corps does not consider compensatory mitigation until impacts to waters of the U.S. have been first avoided and then minimized to the extent practicable. These Guidelines may be modified by the Corps and the Ohio IRT based on public feedback and/or technical concerns which may arise in the future.
