    SUMMARY: The following application has been submitted for a Department of the Army Permit under the provisions of Section 404 of the Clean Water Act. A copy of the application including all supplemental materials (alternative analysis, compensatory mitigation plan, etc.) is available for review in the Huntington District Office. The proposed discharge is in conjunction with the expansion of an existing refuse impoundment at the applicant's Jake Gore Refuse Facility (S-5057-88, IBR No. 14), which is currently being reviewed by the West Virginia Department of Environmental Protection (WVDEP) pursuant to the Surface Mining Control and Reclamation Act of 1977 (SMCRA).

    Summary: The proposed project is located within unnamed tributaries to Stillwater Creek, approximately one mile southwest of Morristown, Ohio, Union Township, Belmont County, Ohio. The applicant proposes to discharge approximately 1,270 cubic yards of fill material into 1,942 linear feet (If) of seven jurisdictional streams and one jurisdictional wetland for the purpose of extracting coal from the #9 Meigs and #11 Waynesburg coal seams.

The applicant has requested authorization to discharge fill material in waters of the U.S. in conjunction with the widening of 1.2 miles of WV Route 2 to a four-lane highway with a continuous center turn lane.
